official contest rules

These are the Rules for the Dermalogica, Inc. (“Dermalogica”) “My Favorite Dermalogica Product” video contest.

Eligibility: This contest is open to all legal residents of the United States, subject to prohibitions in the various states, territories, and possessions, and subject to the further requirements of these Rules. Entrants must be 18 years of age or older on the date of submission. Dermalogica’s (and its affiliates’ and subsidiaries’) employees, and their families are not eligible to enter or win. This contest is subject to all applicable federal, state, and local laws and regulations. Your submission constitutes your agreement to be bound by these Rules.

Description of Contest: Entrants will submit a short video detailing the entrant’s favorite Dermalogica® product, and demonstrating why they love the product (the “Entry”). The contest is open only to licensed skin care therapists who work at an authorized Dermalogica account as of the date of submission of the Entry.

How to Enter: Entries may be submitted either (i) via on-line file transfer in accordance with the conditions on the entry homepage (www.dermalogica.com/famous), or (ii) on a CD or DVD via United States mail to Dermalogica, Inc. attn: Famous, 1535 Beachey Place, Carson, CA 90746. Entries must be received (or postmarked, as the case may be) between 12:01 a.m. PDT July 1, 2009 and 12:00 midnight PDT September 15, 2009. In addition, Entries must:

1.    Run no longer than three minutes in length.
2.    Focus on Dermalogica® brand products.
3.    Include only Dermalogica® brand personal products. No other personal product brands will appear in any Entry. Entries that include comparisons or statements about products competing with Dermalogica® brand products, in particular, will be discarded.
4.    Not include any profanity or vulgarity. Entries judged to be in poor taste will not qualify as an Entry. All Entries must be in English.
5.    All Entries must be submitted in one of the following four digital formats: (i) QuickTime® video (i.e. .mov), (ii) Audio Video Interleave (i.e. .avi), (iii) Windows Media Video (i.e. .wmv), or (iv) Moving Pictures Experts Group 4 (i.e. mpeg-4 or .mp4).

Entries that do not meet these requirements will be discarded. Entries will not be returned to the entrants. Dermalogica reserves the right to remove Entries from the contest in it sole discretion.


Ownership: Entrants represent and warrant that:

1.    The Entry is the work solely of the Entrant,
2.    The Entry as a whole, and the constituent parts of the Entry, do not and will not infringe on any rights of any third parties, including, without limitation, copyrights, trademarks, and rights of publicity.


Judging Criteria: Entries will be judged by a panel of internal Dermalogica staff, including members of the Marketing, Sales, Education and Management teams. Entries will be scored and judged on a ten-point scale on three criteria: (i) creativity, (ii) passion and devotion for Dermalogica® brand products, and (iii) broad audience appeal. Winners will be selected in a two-phase process:

1.    In Phase 1, the top ten Entries will be posted on the publicly-accessible dermalogica.com/famous no later than October 1, 2009.


2.    In Phase 2, Dermalogica will select the Grand Prize Winner on or before November 1, 2009. The winning Entry will be announced at www.dermalogica.com/famous upon selection.


Assignment: By submitting your Entry, you assign all right and title to the Entry to Dermalogica, including the all right and title to any copyright in the Entry, and all of its concepts, components, and elements. You understand that Dermalogica and its affiliates will have full ownership of the Entry, and may make whatever use of the Entry that they wish, including commercial use. Entries will not be returned to the entrants.

Prize Description: Grand Prize. Dermalogica will award one grand prize to the winning Entry. The Grand Prize will consist of a 3 day / 2 night trip for two to Los Angeles, California, including a visit to Dermalogica on Montana. Dermalogica will book the winner and a friend a one round trip coach airfare from the winner’s home to Los Angeles, California, and will provide a two night stay at a Los Angeles area hotel. Dermalogica will also provide ground transportation for all Dermalogica scheduled events during the winner’s stay, including transfers from and to the airport. Runners-up will receive a collection of Dermalogica’s outstanding products, selected by Dermalogica. Prizes have no cash value. Winners are responsible for all taxes associated with claiming a prize.

Claiming the Prize: If your Entry is judged to be the winner, your prize will be awarded to you subject to the following conditions:

1.    You will sign a written release and assignment of the Entry to Dermalogica.
2.    You will provide any additional documentation reasonably requested by Dermalogica, including appropriate personal likeness releases for those persons appearing in the Entry.
3.    Coordination of schedules with Dermalogica staff.

Disputes: Any and all disputes arising from or associated with the Contest, including the award of prizes, will be addressed solely in a binding arbitration proceeding conducted at JAMS and in compliance with the JAMS procedures and rules. Any such arbitration will occur in the JAMS office closest to Los Angeles. The parties will bear their own costs in any arbitration or other proceeding.
